| Annotation | The issues of anticipatory release of the detained persons and convicted persons, who are suffering from severe illness, national and foreign experience of solving this issue based on the example of HIV-infected persons and those suffering from AIDS are characterized. Medical and legal aspects of anticipatory release are analyzed in detail. A comparative legal research of the grounds and forms of anticipatory release in the countries of Europe is carried out. The norms of the Constitution of Ukraine, Criminal, Criminal Procedural and Criminal Executive Codes of Ukraine as well as norms of other legal acts are analyzed. System of organization of medical care, which is provided to convicted persons, is elucidated. Attention is also paid to the algorithm of release of the convicted persons, who are suffering from a severe disease (HIV/AIDS) from further serving a term. Mechanisms of a public and international control over observance of the rights of the convicted persons are characterized. |
