The issue of the legal regime of a website actually remains almost disregarded in the scientific literature. Given an insignificant number of works focused on the study of an Internet website as the object of IT-law and intellectual property law, it should be noted that in the legal literature no unified approach to the understanding of its legal essence has been formed so far. The purpose of this article is to characterize a website as the object of IT-law and intellectual property law, to elucidate its legal regime, describe the characteristic signs of an Internet website, and to present own vision about the improvement of legal regulation of these relations. It is found that a website as the object of IT-law does not exist beyond the Internet. It is established that by its contents, a website is a collection of data, electronic (digital) information and other objects of copyright and (or) related rights, and all of the information materials of an Internet website are interrelated and structured within the address of a website and (or) the account of this website’s owner, and the website is accessed via the address on the Internet (domain name, a record of directories or calls and (or) a numeric address according to the Internet protocol). The author arrives at the conclusion that an Internet website is a complex object of IT-law and intellectual property law, because it comprises software tools (relevant computer programs making a website operational), has its information contents (texts, pictures) and a unique domain name (which usually reflects a trademark of goods and services, a commercial name or a name of an individual), the information on the website is stored on a remote computer (hosting) and may be accessed from any computer (or another device) connected to the Internet through the use of relevant software (public access of any person). |
