Annotation

On the basis of the analysis of current trends in theoretical and practical judgment of participation of courts in the course of law-making a conclusion that judicial lawmaking is an immanent property of justice which though has the limits is proved in article, however it cannot be excluded from activity of court as it is put in the nature of justice. In this regard the main reasons and the directions of judicial law-making, and also limits of a judicial law-making diskretion are analyzed.
