Annotation

The peculiarities of the 2016 constitutional reform in Ukraine are highlighted; a stress in made on the provisions that deal with an access to justice and lawyering monopoly. The comparison of the Fundamental Law of Ukraine rules with the analogical acts of particular European states (Poland, the Federal Republic of Germany, Spain and Italy) in the part of advocacy institute and the right to legal aid provision is as to the institute of professional advocation in Ukraine are presented as well as proposals concerning its perfection. Constitutional changes to professional (advocation) legal aid in Ukraine are considered (by authors) as not successful enough and, in their opinion, lawyering monopoly should not have been fixed legislatively, and international advocacy (lawyering) experience should be used taking into consideration national realia. The ways of strengthening the access to justice guarantees in Ukraine are outlined.
