| Annotation |
In the article on the basis of general provisions of the functional approach in scientific knowledge, the functional approach which includes the tasks and functions of the criminal law is considered in criminal law research. The major (protective, regulative, preventive) and additional (educational, compensation, and incentive) functions are identified and analyzed. It is suggested that the functions of criminal law should be considered at the general level (branches of law) and special one (institutions, concepts). The author also analyzes the functions of the concepts of «crime» and «corpus delicti». |
