In article is considered the lawyer's profession in the United States of America who was and remains decentralized, regulating, behavior canons, examinations and the admission to professional activity went first of all to the level of colony, and now — to state level. In the USA is not present and there was never a «nationwide» lawyer of specialty or Bar though there are important national social organizations which play a significant role in American legal education and vocational training of lawyers (The American Bar, etc.). To sign of «Bar» in the USA the fact that this word can be used in a form of the plural is prime — each state and the District of Columbia have own Bar and regularly carry out own procedure of the admission to lawyer practice. These are realities complicate a possibility of generalization of certain aspects of legal practice in the USA. Historically it developed that the admission in Bar is closely connected with quality of vocational training of the expert lawyer. Now in the majority of states standards of the admission to Bar cardinally raised. Practice when requirements about existence of degree in the field of the right acquired at the school of the right accredited by the American Association of Lawyers are imposed to candidates is quite widespread. Examination which grants the right to be engaged in lawyer practice is the written test which lasts 2–3 days, it is the test of the multiple choice which included questions on all primary branches of the right of the corresponding jurisdiction. Often for check of compliance to this criterion the personal interview with the candidate is appointed by requirement imposed to the candidate (lack of a criminal record or the recorded cases of immoral behavior). If the candidate meets all requirements, he is called in the relevant court of a certain jurisdiction where it officially the oath as the member of Bar and to it is issued the corresponding certificate. |
