Annotation The article deals with the question of jurisdiction of the European Court of Human Rights and courts of Ukraine. The characteristic of the European Court as one of the key elements of the institutional system of the Council of Europe is suggested. It is noted that the ratification of the European Convention and other international treaties that define the direction of the European states, made the adoption of the new Constitution of Ukraine in 1996 possible, which significantly expanded the constitutional and legal forms of protection of the rights and freedoms of man and citizen. Features of execution of ECtHR judgments in Ukraine are covered in the article. It is shown that one of the main problems that lead to finding violations of the Convention in Ukraine by the Court is a deficiency in the judicial practice of the domestic courts. Based on the analysis of this issue provided are suggestions for the improvement of the current legislation.
