| Annotation |
In the article understanding of equality and proportionality as a constitutional elements of justice is grounded. The principle of equality subordinates to the principle of proportionality, because the proportionality defines the incidence of equality. Proposals of the legislative fastening of the principles of equality and proportionality in the Соnstitution of Ukraine in accordance with the practice of the European Court of Human Rights are advanced. |
