Annotation The article is dedicated to the study of civil society, correlation between the issues of its development and institution of mass action. The main function of civil society is forming and representing public interests before the state by the subjects (public associations, political parties, movements), as well as ensuring effective dialogue with the government for their protection and settlement of potential conflicts arising on the basis. The author states that due to the protection of rights and interests of an indefinite number of persons there is a bulk of procedural issues, primarily related to the lack of regulation of the institute of mass (class) action in the civil procedural legislation of Ukraine, which makes effective functioning of the procedural structure of mass (class) action impossible.
