| Annotation |
The peculiarities of realization of certain principles of criminal proceedings and problem questions of their application during revision of judgments in the courts of appeal and cassation instances are analyzed in the article. It was clarified that the procedure of revision of judgments in appeal and cassation instances, provided by Criminal Procedure Code of Ukraine, generally corresponds to the principles of criminal proceedings and the European standards in the field of human rights. At the same time, some provisions of the Criminal Procedure Code relating to specified activity, need a certain specification and adjustment for creation of available mechanisms on protection of the rights and freedoms of participants of criminal proceedings at the appeal of their judgments. |
