The scientific analysis of opinions by scientists and practical workers on determination of the notion of investigative (inquiry) actions, as well as the analysis of the corresponding provisions of the new Criminal Procedure Code of Ukraine is carried out in the article. The subjective approach to scientific interpretation of this notion is proved to be unfounded, more rational would be approach, based on the narrow sense of the term «investigative actions», which is related to such terms as «track», to «to follow the trail», «investigation» etc. Based on the essential features of investigative (inquiry) actions the author suggests his own definition of the notion under consideration. Based on the analysis of both scientific sources and provisions of the new Criminal Procedure Code of Ukraine the author exposes a personal vision of types of investigative (inquiry) actions. |
