| Annotation |
Such notions as «criminal proceeding», «criminal trial», «procedure» and a «stage of criminal procedure» which belong to the basic definitions of the riminally-remedial science are analyzed in the article. The research is carried out on the doctrinal level based on the analysis of a legal consolidation of these notions in both regulations of the Criminal Procedure Code of Ukraine and in the legal theory. The author defines in the article that notion «criminal proceeding» is used by legislator as a synonym to such notions like «criminal procedure» and a «criminal trial», and the «procedure» as a separate part of the whole criminal proceeding, which is characterized by certain essential features that cause a necessaty of legal regulation. |
