| Annotation |
The article is devoted to the research of the principles of using the alternative methods of commercial dispute resolution in Ukraine. The author provided the identification of the alternative methods of commercial dispute resolution, where the special attention s paid to the purpose of these methods. Concept and nature of the term «principles» was analyzed and as a result the definition of the principles of alternative methods of commercial dispute resolution was made. Various classifications of principles were examined and as a result individual characteristics were suggested, dividing them into basic and special. The author provides the examples of these principles in the application of the mediation and the arbitration. The fact that clarification of the content of each principle will create a platform for efficient and effective usage of the alternative methods of commercial dispute resolution is proved. |
