The issues in the modern understanding of essence of the legal property regime are investigated in the article. The author provides the analysis of basic approaches to investigation of the concept and essence of the legal property regime. A Formation of the legal property regime is concluded to be a special method of the legal adjusting. Based on undertaken research the author formulates a concept of the legal property regime. The concept should be understood as a complex of grounds, terms, legal facts and circumstances; provided for by law, agreement, charter of legal entity, that determine acquisition and stopping of right of ownership, order of realization a proprietor or face of the competence possession, use and disposing of objects of right of ownership authorized by him, and also methods of his defense. The legal property regime is suggested to be understood as an original combination of facilities and methods of the legal adjusting of relations, concluded regarding the possession, use and disposing of material welfares. |
