| Annotation |
The article describes the problems of determining general concept of subject of a transaction. In legal literature, conflicts between the spheres of «due», «things in existence» and «knowledge about due and things in existence» state a scientific problem. All in all, accepting this approach, the author conducted the methodological research in the same order (the sphere of «due», «things in existence» and «knowledge about due and things in existence»). The author examines both national and foreign legislation in the area of «due», law enforcement — in the field of «things in existence», doctrinal approaches to the definition of the subject of a transaction — in the area of «knowledge about due and things in existence». |
