| Annotation |
The present article is concerned with the questions of taking evidence in international arbitration. In the light of unification trends in international arbitration and the interaction of legal cultures and traditions the author points out the practical features and provides recommendations regarding the rules and techniques of taking evidence, reveals the peculiarities of witnesses and experts participation, disclosure and submission of written documents. Special attention is paid to description of the trends and the latest amendments to the Rules of Taking Evidence in International Arbitration elaborated by the International Bar Association, the use of which has been extended considerably in international arbitration, both commercial and investment. |
