Annotation

The author maintains the teacher of law should teach the students what the law is, that is what the courts do; he should not hide his own view but state other views as well. There is not such a thing as natural law, but there are legal values that are common to most legal systems.

The Socratic case method and the case book have advantages over the cours magistral and the treatise, and should be applied, but it does not convey a general view and must be supplemented with some instruction ex cathedra and in texts.

The students should learn to be critical. They should know that sometimes the courts are activist, bend the law and use covert techniques.

Keywords case method, Socratic method, activist courts, covert techniques, teacher’s own views, textbooks and case books, legal realism, common core of the legal systems, natural law, critical attitude.
