| Annotation |
The features of continuing crimes can be general and specific (particular). General features are inherent for any crime as well as for continuing crimes. These features help to distinguish a continuing crime and a continuing act, not a crime. The following general features characterize a continuing crime: social danger, criminal unlawfulness, guiltiness, punishable effect and subjectivity. The specific (particular) features are inherent for continuing crimes as well as for continuing acts, not crimes. Thus the above features do not criminalize an act. Durability and incessant nature are the specific features of continuing act (crime). These features characterize the stage of complete crime. Thus a continuing crime can be committing during the certain period of time on the stage of complete crime. The durability helps to distinguish continuing crimes and acts committed instantly. Incessant nature helps to distinguish continuing crimes and other acts which like continuing crimes may be committed during longer period of time.
