| Annotation |
The article reviews main scientific approaches to the determining legal nature of the agreements that mediate relations in capital building. Given different concepts of understanding the nature of business contracts, the issue of freedom of contract, as well as its functions are studied. Criteria and characteristics of contractual forms in construction are determined. The peculiarities of concluding labor contracts in construction are outlined. The analysis of theoretical sources provided the basis for substantiation the conclusion about the civil nature of labor contracts in construction. Their conclusion and performance are based on private principles of contract law. |
