This article contains an attempt to grasp the doctrine of legal order phenomenon in two main ways. Such a doctrine can receive official status in the fixed by a state or other political institutions regulations, programs and measures for the maintenance, supporting or strengthening of the legal order in society. The doctrine of legal order appears also in the synthesized by scientific community theoretically and practically oriented knowledge about the nature and system of legal ordering of social life, which, due to its credibility and prevalence among academic, professional, political elites and civil society exerts significant influence on the legal consciousness and legal practice. The genesis of the doctrine of legal order in Ukraine covers scientific developments of the XIX century, the Soviet era and the present time. Modern domestic legal doctrine should be based on the ideas which are recognized by civilized world, such as: law as a measure of freedom, justice and formal equality, plurality of legal sources (especially the principles of natural law), standards of human rights and freedoms etc. |
