| Annotation |
The article outlines issue of cassation’s «accessibility» in civil proceedings of Ukraine with justification of the necessity to implement efficient mechanisms of access to judgments cassation appeal. Scientific views on the existing model of cassation appeal of judicial decisions in domestic civil process were analyzed. Ways of civil procedure legislation upgrading were suggested in order to implement functioning of cassation institute as an exceptional, «extraordinary» stage of civil procedure. Particularly, there were offered ways of procedural legislation upgrading for implementation of amendments to the Civil Procedure Code of Ukraine. There was also justified the expediency to implement list of cases categories, where decisions of appeal courts would be final and would not be subject to further appeal. To sum up, there was made a conclusion about necessity to reform stage of cassation appeal of court decisions in civil process. |
