On October 26, 2012 the presentation of the first issue of the scientific-practical specialized journal «Law of the USA» – the appendix to the legal journal «Law of Ukraine» was held at the U.S. Embassy in Ukraine.
The event was inaugurated by the Legal Adviser of the U.S. Department of Justice (U.S. Embassy in Ukraine) Mary Butler. The introductory speeches were made by: the chief editor of the legal journal «Law of Ukraine», Doctor of Legal Sciences, Professor, Academician of the National Academy of Legal Sciences of Ukraine Olexandr Sviatotskyi, Chairman of the Scientific Council of the scientific-practical specialized journal «Law of the USA», Distinguished professor of law, Dickinson School of Law, Pennsylvania State University, foreign member of the National Academy of Sciences of Ukraine, William Butler; chief editor of the scientific-practical journal «Law of the USA», Candidate of Legal Sciences, Associate Professor Natalia Davydova.
In the course of speeches, organizers noted that modern world globalization brings its corrections in the formation of legal framework of each state. Law of any country cannot develop completely isolated from the others. Successful international cooperation of Ukraine, especially in the area of market relations is hardly probable as long as there are significant differences between the legislation of Ukraine and other developed countries. The aim of the journal is to familiarize the Ukrainian audience with the achievements of American legal science and practice. Study of the American legal system attract interest, because the United States of America are considered to be a model of democracy, openness of social and political life, constitutional way of solving problems that arise, for example of ensuring and protection of human and civil rights.
USA and Ukraine are the representatives of the countries belonging to different legal families. For historical reasons, each country has its own legal traditions, sources of law, jurisdictional authorities, formed its own legal mentality and legal culture. Legal diversity makes it possible to speak about originality of their legal systems. However, it should be noted that the current global trend is the convergence and interpenetration of legal families. This allows, along with numerous differences between the law of the USA and Ukraine to find similar and common features. For example, great number of laws, codified acts appeared in the USA, whilst legal precedents as source of law are becoming increasingly important in Ukraine.
Scientific-practical specialized journal «Law of the USA» is a useful and prospective for Ukraine, as it will promote its international integration, development of external economic and foreign policy, creation of prerequisites for the full integration of Ukraine into the international legal framework, improvement of the quality of teaching in higher educational establishments, establishment of graduation specialties on international law, advancement of legal knowledge and legal culture of people.
Material for each issue is selected according to certain topical issue that correlates with the separate components of American law. The topic of the first issue is family law. Particular interest is drawn to such aspects as: the illegal removal of children, international marriages, and international adoption. Existing precedents of illegal export of Ukrainian children to the USA are subject to the Hague Convention on the Civil Aspects of International Child Abduction, October 25, 1980, which was ratified by the USA in 1988 and Ukraine in 2006.
Each issue will contain a number of materials that allow the reader to create a full picture of one or another branch or institute of law in the United States, in particular the decisions of the courts of different instances, legal and regulatory documents, reviews, references and scientific articles.
Also a speech was made by the President of the law firm «Salkom», Doctor of Legal Sciences, Professor, Corresponding Member of the National Academy of Legal Sciences of Ukraine Yevhen Kubko, head of the Department of Private International Law of Institute of International Relations of Kyiv National Taras Shevchenko University, Doctor of Law, Professor, Corresponding Member of the National Academy of Legal Sciences of Ukraine Anatolii Dovgert, Vice President, Head of Kyiv Regional Center of the National Academy of Legal Sciences of Ukraine, Doctor of Legal Sciences, Professor, Academician of the National Academy of Legal Sciences of Ukraine Volodymyr Tykhyi, President of the Constitutional Court of Ukraine (1996–1999 years), a judge of the Constitutional Court of Ukraine in retirement (2004), Candidate of Legal Sciences, Academician of the National Academy of Legal Sciences of Ukraine Ivan Tymchenko, chief editor of the journal «Bulletin of the Public Prosecution Office» a senior Adviser of Justice, Head of the Department of the Relations with the Media of the General Prosecutor's Office Yurii Boichenko, Head of the Department of International Experience Study in the Field of Taxation of the Scientific Research Center for Taxation Problems of the National University of State Tax Service of Ukraine, Doctor of Legal Sciences, Professor Leonid Tymchenko and others.
The presentation was also attended by representatives of the U.S. Department of Justice (U.S. Embassy in Ukraine) and the founders of a legal journal «Law of Ukraine», the members of the Scientific Council and the Editorial Board of the journal «Law of the USA», leading scientists, lecturers of higher educational establishments, government officials, and representatives of media, in particular the chief editor of the Verkhovna Rada of Ukraine journal «Viche» Svitlana Pysarenko.
The participants of the event unanimously agreed that the scientific practical specialized journal «Law of the USA» is a unique publication for Ukraine, a journal of new generation pointed at all-round satisfaction of the scientific, practical, information needs of different categories of Ukrainian and foreign, present and future lawyers. The scale of publishing activity of the journal «Law of Ukraine» with the lead of Olexandr Sviatotskyi is unique in our country and is an example of selfless work devoted to the embodiment of high ideals of democracy, rule of law and human rights in the state.
