Annotation | The article sets out the chief innovations of the Rules of Arbitration of the Vienna International Arbitral Centre (VIAC) which were adopted on 8 May 2013 and are applicable in any arbitration where the statement of claim was served after 30 June 2013. In particular, the author outlines the major changes regarding: 1) joinder of third parties as co-claimants or co-respondents, participation of third parties in the constitution of arbitral tribunal; 2) consolidation of arbitral proceedings; 3) constitution of the arbitral tribunal, including situations where no agreement was reached regarding the number of arbitrators, as well as issues of confirmation of the candidates of arbitrators; 4) appointment of arbitrators in multi-party arbitrations, including situations where one party or a group of persons has failed to reach agreement regarding a candidate, as well as issues of cancellation of any appointment, and appointment or repeated appointment of each of the arbitrators when a group of parties is unable to appoint an arbitrator in a multi-party arbitration; 5) period for and procedure for challenging arbitrators; 6) instances where the case is remitted to the arbitration and appropriate actions in such situations on the part of VIAC Secretary General and the Board, as well as issues concerning additional arbitration costs; 7) expedited procedure which may be utilized irrespective of the amount in dispute; 8) funding of arbitration costs. |
