Annotation The article considers findings of the ICSID arbitral tribunal reflected in the 2012 award in case Bosh v Ukraine with respect to Claimants’ claim regarding Ukraine’s alleged failure to comply with its obligations under the umbrella clause found in the Ukraine-US Treaty concerning the Encouragement and Reciprocal Protection of Investment. In particular, attention is paid to the findings on preconditions to be fulfilled to enable claimant to assert contractual claims under the umbrella clause.
