Annotation | The article deals with the institutional and procedural peculiarities of accession of the European Union to the Convention for the Protection of Human Rights and Fundamental Freedoms, namely the EU’s participation in the work of the Committee of Ministers, the so-called co-defendant mechanism. The author analyzes the Draft Agreement on the Accession of the EU to the ECHR, and stresses the need to preserve the specific features of the EU, EU law as well as the autonomy of the EU legal order, the issue of the division of competence at national and EU level. |
