Annotation This article deals with the direct consequences of the accession of the European Union to the Convention for the Protection of Human Rights and Fundamental Freedoms in the light of the Draft accession, in particular issues of shared responsibility, the co-respondent procedure, appointment of judges to the European Court of Human Rights by the European Union. The author analyzes the indirect effects of EU accession, namely fostering the constitutional character of the CJEU. The author proposes two key words to address human rights issues in Europe: judicial dialogue and margin of appreciation.
