Annotation The competence of the European Court of Human Rights is based on the Convention for the Protection of Human Rights and Fundamental Freedoms of 1950, at the same time rules of general international law play an important role in the process. However, such a role is not always clearly reflected in its practice because some rules were declared in the text of the Convention. Although the Court acts essentially on the basis of these standards, it does not explicitly refer to them. That reveals the «hidden role» of the rules of general international law in regulating competence of the ECHR. The article displays this role.
Keywords general international law, competence of the European Court of Human Rights, Convention for the Protection of Human Rights and Fundamental Freedoms.
