In this paper the author investigates the problem of values and value judgements which is considered as a central problem of the New Rhetoric. The author traces the evolution of the ideas of Chaim Perelman, the founder of the New Rhetoric school, who defined legal and moral values as confused notions. The author investigates the correspondence between the ideas of the New Rhetorics and modern Western legal thought, in particular, in Pierre Schlag's works. |
