Article Reflexivity and the Idea of Law

Annotation The article suggests that the central problem of the nature of law arises from the reflexivity of law: the practices composing a legal system themselves make essential reference to the idea of 'law'. The paper criticises theories, such as the theory of J. Raz, that view the idea of law as one that identifies a particular type of social institution but has no role within adjudicative legal thought.
