On the basis of approach to understanding the law as integrity of rights and duties it is proved the logical impropriety of constitutions of European countries, concerning the human rights, negative influence of such quality of legal thinking on the court practice including the European Court of Human Rights. As a part of this common problem it is considered the issue of disparity of Lithuanian Constitutional Court's activity to the notion «court». |
