In the article the place of the theory of international law in the generaltheory of law is analyzed. The author notes unsuccessful (vain) attempts to establish«independent» theory of international law. Every time, move away from the generaltheory of law put the theory of international in a difficult position, in a situation wheninternational law is identified with foreign policy.The author denotes in the facts of mixing the subjects of researches as a result ofsuch problems. In order to examine such problems he proposes to elaborate the newscientific direction — judicial science of science. He supports the idea of the elaborationof general legal theory as common conceptual basis for the theories of national andinternational law.
