The article explains the crucial role of the system of justice in the assertion of the rule of law in the legal system of the state. It is emphasized that a necessary condition for the rule of law in society is a public confidence to the courts.

Author on the basis of the analysis of judicial practice of Ukraine establishes a formal appeal mainly domestic courts for the rule of law, which negatively affects the level of legitimation of law in society.
