Annotation | The article shows the interpretation of reasonableness of law stated by Robert Alexy. Primarily the author makes the distinction between expression of rationality and reasonableness. He defines reasonableness as a concept used for the assessment of such matters as actions, decisions, and persons, rules and institutions, arguments and judgments, and establishes its basic requirements. The article shows the relationship between balancing and reasonableness. Besides it he also reveals the structure of balancing. At the end of article R. Alexy defines the connection between law and reason: reason requires law in order to become real, and law requires reason in order to be legitimate. |
