| Annotation | The article examines the notion «personal database» embodied in the valid Law of Ukraine «On Protection of Personal Data». Based on circulation and the processing of personal data the author proposed to amend the legislation and define the notion «personal database» as a set of personal data in any form, including electronic form and/or in the card form, elements of which are available individually and can be found using a search engine based on electronic (computer) or other means. In order to guarantee privacy in ensuring safety of circulation and processing of personal data, the author suggests envisaging the classification of personal data bases in law with the subsequent introduction of a special legal regulation of circulation and/or processing of personal data in different databases. The author offers to classify personal databases based on the following criteria: 1) objective form of existence, 2) personal database access procedure, and 3) procedure to access information, contained in the personal data base. |
