Annotation | The article explores different narratives of marriage that have been used by proponents and opponents of same-¬sex marriage and shows how those different narratives affect constitutional arguments in favor of same sex marriage. One of the narratives of marriage told by opponents of same sex marriage celebrates marriage as a purposefully gendered institution. Although rarely openly discusses, this narrative accurately reflects the way marriage operates in most married people’s lives and, as a doctrinal matter, it reveals a critical tension between the fundamental rights and equality arguments for same sex marriage. |
