Annotation | This article discusses the national and international attempts at developing some uniform standards for relocation guidelines, the constitutional and fundamental rights of parents in the relocation context, and the current lack of uniformity in relocation laws. The definite trend appears to be moving towards a neutral “best interests of the child” approach using multiple factors to analyze relocation requests. The challenge is how to make the best interests test actually focus on child¬-centered factors that take into consideration the individual child’s developmental stage, resilience and adaptability, relationship with both parents, and the child’s voice. |
