Annotation | The United States Constitution protects certain rights related to family matters. Those rights cannot be abridged by the state absent a showing that compelling state interests would be undermined unless those rights were overridden. This Article examines those rights that have been designated as protected and why the most plausible construction of the relevant jurisprudence entails that the right to marry a same¬-sex partner should be found protected as a matter of federal due process guarantees. |
