Legal nature of judicial practice is in-process probed. Legal maintenance of concepts «identical application», «unity», «compatibleness» of judicial practice, opens up. On the basis of theoretical analysis of positions of current legislation of Ukraine, an author draws a conclusion, that the row of positions needs perfection, especially in part of expansion of plenary powers of Supreme Court of Ukraine and his Plenum in relation to providing of standardization of judicial practice; in the legislative fixing need and decisions of concept «judicial practice» or «precedent court decisions» and formalization of forms them обективации, and also decision of concept «of the same type application right».
