In the article based on analysis of the civil procedural evaluation concept «exceptional case» proposed the definition of this concept, defined the elements of its content and scope, which helps to create conditions for more effective and consistent application of civil procedural evaluation concept in practice. Emphasized the importance of qualitative reasoning of judgments for the correct application of civil procedural evaluation concept.
