The article explores the essence of the right to a fair trial in the context of its adaptation to the protection of specific human rights. The European and Ukrainian practice of legal proceedings in cases concerning the protection of the right to respect for private and family life has been studied. Examples of improper enforcement by national courts in the resolution of disputes on the protection of personal data are given. The ways of improving activity in the field under investigation are suggested.
