In article the sketch of the procedural doctrine concerning the doctrine about a  subject of a civil procedural law is given. Need of further reconsideration of a  problemof a subject of a civil procedural law is proved considering influence of the Convention on human rights protection and fundamental freedoms and practice of the European Court of Human Rights on the sphere of civil legal proceedings and civil process in general as systems of institutional elements of judicial authority, non-judicial bodies of the civil jurisdiction and the corresponding civil procedures
