The article is devoted to the problem of abuse of right, which is comprehended as violation of appropriate legal procedure and as an obstacle for functioning of fair judicial proceedings. The author proposes to proceed from the fact that counteraction to abusing procedural rights on behalf of court shall be estimated on correspondence to the principle of proportionality as observing balance between private and public interests.
