The article is devoted to the analysis of the draft of Commercial Procedural Code of Ukraine within regulation of ensuring of a suit. The draft Code proposes to introduce numerous novelties of legal regulation: counter-ensuring, change of one type of ensuring to another, cancellation of the ensuring, exclusion of the court from the initiators of the claim. The expediency of combining in one chapter both preventive measures and measures to ensure a claim is analyzed. A range of subjects has been specified that have the right to claim to the court for suit ensuring, counter-ensuring, change or cancellation of suit ensuring measures. The issue of the procedures for review by the court of relevant applications was investigated and the gaps in their regulation were identified. The expediency of determining an additional basis for changing or canceling the suit ensuring measures is substantiated.
