Abstract

ABSTRACT. The foundations of the concept and content of the Ukrainian Law “On Private International Law” were created in 1992–1996. Since then, for near three decades, much has changed in Ukraine and the world in economic, political and legal terms. Looking at private international law (PIL) area, new approaches to conflict-of-law decisions have been further developed and reflected in EU regulations and the documents of the Hague Conference on Private International Law. It should also be noted that in the XXI century the most modern ideas of conflict-of-law regulation are embodied in numerous new national codifications of PIL, both in the framework of civil codes and in special laws.
The article substantiates the need for recodification of the PIL as a component of the modern renewal of private law in Ukraine, and shows the basic ideas of modernization of conflict of laws regulation.
Thus, big changes in Ukraine and the world in economic, political and legal terms suggest further updating PIL in the following main directions: (i) strengthening the private-law grounds of conflict-of-laws; (ii) giving choice-of-law rules greater flexibility while maintaining their certainty; (iii) further ‘materialization’ of conflict-of-laws (its focus on the material result of a decision made in a particular case); (iv) clarifying of the unilateral approach for resolving the conflict issue.
Possible ways to improve certain legal institutions and categories, in accordance with the specified world directions of the PIL’s development, are illustrated on the material of the general provisions of codification.
An important task of the update is to bring the codification of PIL back to the structure of the Civil Code of Ukraine 2003.
