Annotation

Currently, reforms of the Ukrainian criminal executive policy are made haphazardly, without respect to the basic initial parametrium of sociogenesis. It should also be noted that there is no proper scientific support for practical attempts of optimization, this resulting in a significant dysfunction of the attempted reforms. At the same time, modern criminological and criminal executive doctrines do not utilize any practical adaptive developments capable of synthesizing the achievements of rationalism and historicism in the criminological domain. These achievements are visualized on a functionally broad plane of the institutional framework for reforms of the criminal executive policy.

The purpose of the article is to identify, describe and explain the interrelation between the criminal executive policy and the political and legal institutions of modern Ukrainian society, and also to determine the strategic approach to enhancement of their criminological efficiency.

The author proves that the nature and efficiency of reforms of the criminal executive policy depend on the functional parameters of the politics institutions. Given that a significant segment of public administration has a simulation nature in terms of forming and implementing the real political will which is subordinated to private and corporate interests in the area of public resources use, the author argues that the criminological and criminal executive policies should be joined on the grounds of systematically reducing the intensity with which the political crime factors are reproduced, and also the extent of crime in politics and economic institutions. Thus, forming a specific range of goals and objectives, the criminal executive policy is meant to ensure complementarity with strategic objectives in the domain of combating crime, assuring criminological security, liberalizing economy and social order in general.

The author highlights the need for further demilitarization of the penitentiary system by activating its interaction with civil society institutions, their functional interpenetration, and by expanding common communication capabilities based on the principles of openness, transparency, informational content, and criminological efficiency of penal enforcement.
