Article Development of Law as a Conspicuous Feature of the State of Galicia-Volhynia (1199–1349)

Annotation

The article focuses on characterization of the processes through which law was established and developed in the State of Galicia-Volhynia (1199–1349). It is noted that the emergence of the State of Galicia-Volhynia is an important milestone in the history of Ukrainian statehood. This State reached a significant level of political development and in terms of economy and culture was among the most advanced countries in Europe at that time.

The author gives considerable attention to the analysis of customary law, “Rus’ Truth”, principality’s legislation, Magdeburg law, and church law of the State of Galicia-Volhynia. Legal regulation of public relations in the State of Galicia-Volhynia rested upon the sources of law of Kievan Rus’. The State of Galicia-Volhynia used Kievan Rus’ sources of law because they were consistent with its socio-economic development. However, in the environment of new socio-economic, cultural and political relations, the Galicia-Volhynia princes issued charters which further developed and improved many provisions of Rus’ law. There was continuity in the development of the Galicia-Volhynia State’s law institutions, and that continuity involved the presence of and the links between common features in the process of establishment and development of State law institutions uniting and approximating rather than separating them out. At that time, institutions of State law developed from the previous period of the State’s development to the next one, and it occurred sequentially, by turns. There was continuity of the State law processes, phenomena, etc. This continuity was specifically manifested in the Galicia-Volhynia State law, since the major factor ensuring it was the continuity of the State and self-government bodies and legislation. For this reason, the new State law institutions of the Galicia-Volhynia State retained the main features, peculiarities, and properties of the prior State law institutions of Kievan Rus’ (prince’s rule, Veche, customary law, princely legislation, “Rus’ Truth”, canonical law, and other sources of law which were consistent with the new socio-economic and political relations). The article shows that as of 1199, in the State of Galicia-Volhynia the process of formation of the Ukrainian legal tradition was underway, in particular, in respect of regulation of civil, criminal and procedural relations.
