Annotation

Contradictory normative definition, features of the nature of property rights, which distinguishes them from the objects of the material world, lack of their accounting system and state registration, segmental and casual regulation of alienation of property rights to real estate, etc. leads to different understanding of their nature and content and permissible limits of property rights. All this creates space and conditions for abuse, causes an unsatisfactory practice of alienation of property rights to the premises in a built facility after its commissioning, threatens the legal circulation of real estate in Ukraine and leads to other negative consequences, such as violation of rights of a subject, tax evasion, shadowing of assets, etc.

      Specification of property rights as an object and the content of legal relations to explain their transformation, in particular, in the field of real estate construction at the stage of commissioning, to regulate the turnover of property rights to real estate and establish its permissible limits, to justify the need to create and implement systems of accounting and registration of property rights and their subjects and automation of such transformation at the time of acceptance of object commissioning.

        Theoretical and methodological basis of the study are the guidelines of hermeneutics, “post-classical” methodology, methodological principles of dialectics and systems analysis.

        The article distinguishes property rights as the content and object of legal relations, examines the issues of their transformation, identifies factors influencing the content of property rights in the construction of real estate, analyzes the legal significance of the moment of commissioning, in particular, to determine the moment of legal creation of a real estate object and acquisition of ownership of it, makes conclusions on the impossibility, as a general rule, of turnover of property rights to real estate after commissioning of the finished object, as well as the need to develop and implement at the state level accounting system and registration of property rights and their subjects and automation of the transformation of property rights at the time of acceptance of the object into operation is reasoned.

       Regulation of the turnover of property rights to real estate requires systemic changes in the current legislation of Ukraine, creation and implemention of a system of accounting and registration of property rights to real estate and automation of their transformation at the time of commissioning. This will minimize abuses in the field of construction, provide access to all subjects to complete and accurate information about construction sites, property rights to real estate and subjects of law, create additional guarantees for property rights purchasers, solve the problem of double alienation and improve economic situation in the country.
