Annotation

In this article the focus is made on studying the fine as a form of economic procedural liability and a component of effective court protection aimed at preventing and countering of economic procedural offenses. The authors concentrate attention on the issue of determining the legal nature of procedural fines, examine the doctrinal approaches of supporters and critics of the concept of court fines, and mark out different elements of the administrative offense provided for in art. 1853 of the Code of Ukraine for Administrative Offenses (CUAO) and economic procedural offenses provided for in part 1, article 135 of the Code of Economic Procedure of Ukraine (Ukrainian CEP). Special attention is also paid to such an issue as ascribing contempt of court to economic procedural offences, on which basis the authors substantiate the need to empower the economic court with the option to impose a fine on the persons present in the courtroom; the article also gives case law examples which testify to the emerging trend of bringing those who violate the normal course of a trial to procedural liability for contempt of court.

The authors analyze the features of the court fine and classify the specific features of the economic procedural fine seen as general procedural features which make the fine an inter-branch procedural phenomenon, as well as special procedural features which determine the place of the fine in economic court procedure. The authors of the article focus attention on the debatable issue of the need to impose the fine both on a participant to an economic case and an attorney of the latter and illustrate the position which they hold. The functions of the fine which determine its place in economic procedure are analyzed and classified into preventive, stimulating which demonstrates a significant difference between the fine in law of substance and law of procedure, and punitive ones.
