Annotation | The Ukrainian notary like as integral part of the legal infrastructure of society cannot have structural and systemic problems, because they affected of the entire infrastructure. These problems are in different nature, due to the various factors – from the negative past of the Soviet period to modern imperfect legislation, but they are affect the effectiveness of notaries and officials of their main task – to ensure the stability of civil circulation in the state. Today, discussions of the way and direction of notary reform have been actualized by the economic crisis, the results of ill-considered state policy of “manual” notary management, attempts to create a “quasi-notary” – palliatives aimed at ensuring private interests, including land market formation. The legal basis of the expanding of functions and transferring is the notary to the qualitatively new level of E-notary. The purpose of article is to analyze the legal regulation of organizational and legal structure and procedural competence of notaries to identify gaps, conflicts and ineffective rules that in practice do not show an effective result, are inappropriate, outdated or simply harmful; assessment of developments originating from the scientific environment and practitioners on the innovations proposed in the process of reforming the notary; proposal of a new approach in creating the concept of notary reform, the essence of which is complexity: from the development of measures to improve the public status of the notary to the joint reform of the notary and the bodies involved in its functionality. The article has a scientific and applied nature. According to the results of the study, the unresolved problem of a single notary due to the non-abolition of state notaries hinders its unity and unification of rules of activity, as well as creates inequality of payment for public and private notaries; the legislation does not properly present the peculiarity of the dual status of a notary, due to which changes are needed in favor of strengthening the public component of his status; the ineffectiveness of the liberal approach to the formation of the corps of notaries has not yielded positive results, which is why it would be worthwhile to return to quotas; problems related to the inefficiency of legislation on taxation and social security of notaries. The essence of innovations, the implementation of which is required by the notary’s community, is revealed: self-regulation on the basis of NPU, E-notoriety, expansion of the list of notary’s actions and actions of notaries as registrars. Based on the study, the following conclusions were made. Notary reform is necessary on the basis of state recognition of the public role of the notary and in combination with other bodies involved in its activities, prohibition of creation of parallel structures, recognition of tax status taking into account the factor of “self-employed person”, introduction of E-notary innovations. |
