Annotation | The authors of the article analyze the Bill № 5660 “On Enforcement of Decisions” (the Bill 5660), which was adopted by the Verkhovna Rada of Ukraine in the first reading on 14.07.2021 for the basis. However, 1,200 amendments are made to its content and significant remarks are made by the Main Scientific and Expert Department of the Verkhovna Rada of Ukraine. This Bill should be widely and publicly discussed before it is considered by the Verkhovna Rada of Ukraine. Its structure, norms should be so “polished” that at its acceptance there were no negative and unpredictable effects that will lead to turbulence throughout the legal system. That it did not happen as with the Civil Procedure Code of Ukraine, when immediately after its adoption, less than a month later, amendments began to be made. The purpose of the article is to draw the attention of scientists and practitioners to the Draft Law on Enforcement of Decisions № 5660 on the formation of its structure and compliance of its name with the issues regulated in this bill. Particular attention should be paid to the formation of its developers rules governing the list of principles of enforcement proceedings, as well as several rules in which they try to reveal the rule of law and the possibility of its implementation by enforcement agents in enforcement of decisions, as well as the ability to act within justice and such an evaluative concept-principle as a reasonable period of enforcement. The article analyzes the decision of the Constitutional Court of Ukraine on understanding such a legal phenomenon as “rule of law”, the current Law of Ukraine “On Enforcement Proceedings” and the Draft Law on enshrining the principle of rule of law in these acts, substantiates the author’s view on the rule of law activities of the court and the activities of executors in the enforcement of, in particular, court decisions, reasoned conclusions are made. The authors believe that the rule of law is not about the perfection of law and legality, but should be linked to the repeal of laws that are unconstitutional and human rights, as it should be associated with an alternative to the rule of law. If the principle of legality encourages and obliges all citizens to comply with the law, the rule of law implies that some laws may not comply with the Constitution of Ukraine and then the requirements of such laws may not be met. The rule of law is an exception to the general rule if we make the reasonable assumption that the vast majority of laws in Ukraine are in the public interest and do not violate the rights of citizens. Principle legal certainty should not be seen as an element of the rule of law, but as a mandatory element of the rule of law. We do not consider it possible to empower public and/or private executors to act in accordance with the rule of law, to act within the analogy of law or law because their actions must be subject to and permitted by law or court.
